Official Contest Rules

 

I have read these OFFICIAL CONTEST RULES (the “Official Rules”) for Pints & Pixels’s “Jumpman’s Grand Puzzle” (the “Contest”), and by entering into and/or participating in the Contest, I agree to all the rules and regulations of the Contest as outlined below:

 

  1. . No purchase necessary to enter or win. The Contest is open to all legally competent persons over the age of eighteen (18). Employees and their immediate families (spouses, siblings, children, household members and the spouses and children of the foregoing) of Pints & Pixels and any other person or party operating a business location at which a clue is revealed are not eligible to enter the Contest. The Contest is subject to all federal, state, and local laws and regulations. Some restrictions apply. Void wherever prohibited or restricted by law.

  2. HOW TO ENTER. The Contest will commence upon the airing of a video (the “Contest Video”) at Pints & Pixels on March 30, 2018 and will end on April 30, 2018 (the “End Date”). Pints & Pixels may, in its sole discretion, extend the End Date of the Contest.  The Contest Video will set forth the premise of the Contest.  To enter, eligible participants need to follow the clues/hints, beginning with the first clue announced in the Contest Video. Each clue of the Contest will be revealed at a different location.  The Contest Video will also be posted on Pints & Pixels’s social media accounts.  These Official Rules will be available online and at Pints & Pixels.  Pints & Pixels reserves the right to terminate this Contest at any time, and Pints & Pixels is under no obligation to give notice prior to the date of termination.  Pints & Pixels is not responsible for transportation, or failures of any kind of lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit a participant’s ability to participate in the Contest. False or deceptive entries or acts, as determined by Pints & Pixels, will render the entrant ineligible.

  3. HOW TO WIN. Only one (1) person can win the Contest.  The Contest will be won by the first eligible participant successfully meeting the Pints & Pixels representative at the final location revealed in the clues and successfully performing any final tasks revealed in the clues.  The decisions of Pints & Pixels as to the winner of the Contest will be final and binding. The potential winner must meet all eligibility requirements including the execution and delivery of all necessary releases. If the potential winner does not meet all eligibility requirements or return signed any necessary documents within three (3) business days, then that potential winner will be deemed ineligible and Pints & Pixels, in its sole discretion, will choose another potential winner based on the criteria set forth above.

  4. GENERAL RULES AND REGULATIONS. By entering this Contest, participants grant Pints & Pixels the right, unless prohibited by law, to use their names, voices, pictures and likeness, without further authorization or compensation, for the purpose of advertising and publicizing the goods and services of Pints & Pixels and all matters related to the Contest in any manner or medium, through the world in perpetuity. The winner will be required to sign and execute affidavits of eligibility, tax acknowledgement forms, liability releases and, except where prohibited by law, use of name and likeness releases (“Winner Documents”) and return the same within three (3) days of issuance. Noncompliance with this time period may result in disqualification. In the event the winner declines the prize or fails to return completed releases, Pints & Pixels may elect, at its sole discretion, to select an alternate winner. If no eligible potential winner can be identified after reasonable attempts or if delays in obtaining the completed Winner Documents would make it impracticable to award the prize due to the timing of the Contest, no substitute prize may be awarded in Pints & Pixels’s sole discretion. All entrants agree to follow all applicable laws and regulations during their participation in the Contest and understand that breaking any law, reckless activity or behavior that threatens the safety of others in any way will be grounds for immediate disqualification and is explicitly prohibited. Pints & Pixels expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prizes awarded.

  5. . One (1) winner will receive: (i) 10 tokens a day for a year at Pints & Pixels, (ii) a home-size full arcade cabinet PacMan game, and (iii) a copy of the book Ready Player One™ signed by Earnest Cline. The prize(s) shall be subject to and conditioned upon the winner completing, and submitting to Pints & Pixels, the Winner Documents.  All costs, taxes, fees, and expenses associated with any element of any prize not specifically addressed above are the sole responsibility of the winner. The reporting and payment of any tax liabilities incurred by the entrant as a result of this Contest and any prize(s) won are the sole responsibility of the entrant. No substitution or transfer of prize(s) or cash redemptions are permitted. Pints & Pixels reserves the right to substitute a prize of like value in the event the described prizes, or any portion thereof, are unavailable for any reason whatsoever.

  6. DISCLAIMER OF LIABILITY.  In no event shall Pints & Pixels be responsible or liable for any consequential, indirect, incidental, special, exemplary, punitive, or enhanced damages, lost profits or revenues, or diminution in value, arising out of or relating to the Contest, regardless of (i) whether such damages were foreseeable, (ii) whether or not entrants were advised of the possibility of such damages, and (iii) the legal or equitable theory (contract, tort, or otherwise) upon which the claim is based, and notwithstanding the failure of any agreed or other remedy of its essential purpose.

  7. Acknowledgement and Release.  By entering into this Contest, entrants agree: (i) to abide by the terms of these Official Rules and the decisions of Pints & Pixels, which are final and binding on all matters relating to this Contest; and (ii) to release, discharge, indemnify and hold harmless Pints & Pixels and its shareholders, officers, directors, employees, suppliers, licensors, contractors, and agents against and from any loss, debt, liability, damage, obligation, claim, demand, judgment or settlement of any nature or kind, known or unknown, liquidated or unliquidated, including without limitation, all reasonable costs and expenses (including litigation costs and attorneys’ fees) arising out of or relating to any claims, complaints, actions, proceedings or suits of a third party arising from or in connection with participation in and/or for entry into the Contest, any related activities, or acceptance or use of any prize won.

  8. Waiver of Jury Trial. EACH ENTRANT HEREBY WAIVES ITS RIGHTS TO A JURY TRIAL OF ANY CLAIM OR CAUSE OF ACTION BASED UPON OR ARISING OUT OF THE CONTEST. THE SCOPE OF THIS WAIVER IS INTENDED TO BE ALL-ENCOMPASSING OF ANY AND ALL DISPUTES THAT MAY BE FILED IN ANY COURT AND THAT RELATE TO THE SUBJECT MATTER OF THE CONTEST, INCLUDING, WITHOUT LIMITATION, CONTRACT CLAIMS, TORT CLAIMS (INCLUDING NEGLIGENCE), BREACH OF DUTY CLAIMS, AND ALL OTHER COMMON LAW AND STATUTORY CLAIMS. EACH ENTRANT HEREBY WARRANTS AND REPRESENTS THAT SUCH ENTRANT HAS REVIEWED THIS WAIVER AND THAT SUCH PARTY KNOWINGLY AND VOLUNTARILY WAIVES ITS JURY TRIAL RIGHTS.

  9. . All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Pints & Pixels, shall be governed by, and construed in accordance with the laws of the State of Alabama, without giving effect to any choice of law or conflict of law rules or provisions (whether of Alabama, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Alabama. In any action brought to enforce the obligation or right of any party hereunder, entrants consent to personal jurisdiction and venue in any court of appropriate jurisdiction in Huntsville, Alabama. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

No purchase or payment necessary to enter or win this Contest.  A purchase or payment will not increase your chances of winning this Contest. Hi, I’m Richard Moss, founder of Pints & Pixels -- a restaurant, bar and classic arcade in downtown Huntsville, Alabama.

 

In gaming circles I often go by the handle, “Jumpman”.

By now most of you have read or heard of the book Ready Player One.

 The film adaptation premiers tonight and we really hope it does the book justice.

In Ready Player One, James Halliday aka Anorak, an eccentric billionaire, sends players on a quest to find an Easter egg he has hidden somewhere in his massive online game.

The owners of Pints & Pixels have decided to run a quest of our own.  We call it, “Jumpman’s Grand Puzzle.”

 Like Halliday, we too are obsessed with geeky things and 80s pop culture, therefore those themes are prevalent throughout our quest.

To win our prize you’ll need to solve riddles and puzzles, play some old-school video games, and do a bit of performing.

Just to be clear, completing this quest will be neither quick nor easy. You will have many tests to overcome. Sometimes you may have to wait for places to open and you will not be able to skip ahead.

It's a progression quest where one thing leads to another and sometimes you will need information from a previous step to solve the section you’re currently working.

A difficult quest deserves a worthy prize. The first person to complete our puzzle will receive a special badge good for 10 tokens per day for one year at Pints & Pixels, a cabaret size commercial Pac-Man arcade game and a copy of Ready Player One signed by the author, Earnest Cline.

As in The Highlander, there can be only one … winner.

To steal a line from Anorak in the book:

 

Three hidden keys open three secret gates
Wherein the errant will be tested for worthy traits
And those with the skill to survive these straits
Will reach The End where the prize awaits

We wanted to give you a little help so we have set up Jumpman's Journal on FaceBook.

 

It will serve the same function Anorak's Almanac did in the Ready Player One: a sampling of some of the geeky 80s things we love.

Plus, it will serve as your “gunter” message board in case anyone wants to discuss the quest, share information or ask for help.

 

You’re welcome to team up if you like but as we said before - there can be only one winner.

Now I’d like you to meet Steve.  You've probably noticed him hanging around Pints & Pixels.

Steve will help guide you along your quest. Wherever the quest takes you, you’ll find Steve

somewhere nearby.

 

If you find yourself in a location that has no Steve you probably need to re-think the previous clue.

Our quest will take you to some of our favorite spots all over Huntsville and the surrounding areas.

 

While questing, we ask that you please show respect for the property and employees of the places you visit.
